PRINCIPLE
TERMS & Physiques Gym LTD Waiver and Release of Liability
Physiques Gym Ltd known as “us” “we” or “our”.
GENERAL TERMS
You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you reasonable advance notice of the change.
If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced. You may transfer your membership to another person provided that such person pay a Joining Fee signs an agreement with us and accepts the balance of any remaining Minimum No. of Direct Debit Payments.
We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.
If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply
We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.
Health & Safety
You are responsible for ensuring you are fit to exercise. If in doubt, seek medical advice before starting a fitness programme.
You must disclose any relevant health conditions on joining and update us if your circumstances change.
If you feel unwell while exercising, stop immediately and seek assistance.
You must comply with our emergency and safety procedures at all times.
Personal Belongings
Lockers are provided for day use only and must be emptied after each visit.
We are not responsible for loss, theft, or damage to personal belongings brought onto our premises.
For the safety and wellbeing of everyone, babies and young children are not permitted in any gym areas. Our facility contains heavy equipment and environments that may be unsafe for children.

CHILDREN UNDER 14 YEARS OLD PERMITTED IN ANY GYM AREA
AGES 14–16: Access is permitted ONLY with parental/guardian consent.
Access to the facility for individuals aged 14–16 is permitted only where a parent or legal guardian has provided consent through acceptance of these Terms and Conditions and accepts full responsibility for the minor. The parent or legal guardian acknowledges the inherent risks associated with the use of gym equipment and physical exercise and agrees that the facility, its owners, and staff shall not be held liable for any injury, loss, or damage sustained by the minor arising from the use of the facility, except where such loss or injury results from our negligence. The parent or legal guardian further agrees to indemnify the facility against any claims arising from the minor’s use of the premises.”
Liability
You use our facilities and equipment at your own risk.
We are not liable for injuries, accidents, or health issues arising from use of the gym, except where caused by our negligence.
We do not guarantee specific fitness outcomes or results.
Privacy & Data Protection
We process your personal data in line with our Privacy Policy, which complies with UK GDPR and the Data Protection Act 2018.
CCTV is in operation for security and safety.
Termination by Us
We may suspend or terminate your membership if you:
1. Fail to pay fees
2. Breach these Terms or gym rules
3. Engage in misconduct, abusive behaviour, or activities that endanger others.
No refunds will be issued where termination is due to misconduct.
FEES AND CHARGES
You agree to advise us promptly of any change to the Members Details you provided.
MYMEMBERSHIP will show on bank statements this is us.
1. This agreement is an agreement between you and us
Your membership starts immediately unless you choose at the time of sign-up, a start date in the future (not available on all membership options).
2. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen, subject to your timely payment of the fees and charges set out below and the successful processing of your payment instruction.
AUTOMATIC RENEWAL AND STANDARD CANCELLATION OF THIS AGREEMENT
Direct Debit Payments we will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal Direct Debit payment amount may only be amended if we advise you in writing giving not less than 14 days notice. Please note if your membership included the benefit of a free period then we will stop making collections during that free period and recommence making collections on the renewal date.
You may prevent the Automatic Renewal at any time by giving notice to us by by email/app/in person. We require 14 days notice of cancellation so the collection will be stopped. If you advise us with less than 14 days notice, one more further monthly payment will be taken by us before your cancellation becomes effective.
Once you have completed the Minimum Number of Direct Debit payments you can cancel your Automatic Renewal payments by contacting us by email/app/in person/in writing. We require 14 days notice of cancellation (you should give us not less than 14 days notice). If you advise us with less than 14 day’s notice, one more further monthly payment will be taken by us before your cancellation becomes effective.
Physiques Gym LTD Waiver and Release of Liability
This Waiver and Release of Liability Agreement is entered into by the Participant in consideration for access to and use of the facilities, equipment, and services (“Facilities”) provided by Physiques Gym LTD
Acknowledgement of Risks
I understand and acknowledge that:
Use of the Gym’s Facilities, including but not limited to exercise equipment, weights, locker rooms, and open areas, involves inherent risks of injury, illness, or even death.
Risks include, but are not limited to: slips, falls, overexertion, equipment malfunction, improper use of equipment, exposure to other individuals, and lack of immediate supervision (particularly during 24-hour / all-hours access).
I am responsible for my own safety when using the Facilities, the gym does not provide continuous staff supervision (out of hours).
Health Declaration
I represent that:
I am physically fit and have no medical condition that would prevent safe participation in physical activities.
I have consulted with a physician regarding exercise participation if necessary.
I will not use the Facilities while under the influence of alcohol, drugs, or any substance that may impair judgment or physical ability.
Assumption of Risk
I voluntarily assume full responsibility for all risks, known and unknown, associated with use of the Facilities, whether supervised or unsupervised, including those that may result from the negligence of the Gym, its owners, employees, or agents.
Release of Liability
I hereby release, waive, and discharge the Gym, its owners, employees, contractors, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, disability, death, or property damage I may suffer while using the Facilities.
Indemnification
I agree to indemnify and hold harmless the Gym from any loss, liability, damage, or costs incurred due to my use of the Facilities, whether caused by negligence or otherwise.
Access Rules and Responsibilities
I agree to:
Use my personal access credentials (e.g., key, key fob, code) only and not share them with others.
Follow all posted rules, instructions, and safety guidelines.
Report damaged or unsafe equipment immediately.
Use spotters or take precautions when lifting heavy weights.
Recognize that emergency assistance may be delayed due to unstaffed hours.
Severability
If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgement
I have read and understood this Agreement, fully accept all terms, and accept on the parQ. I understand that by accepting this Agreement I am giving up substantial legal rights, including the right to sue.
